Model & Property ReleasesIf the photograph contains the image of recognizable person, it is their right to agree or disagree with the use of the image. To submit a photo representing a person, the photographer must make sure the image was not captured while violating the persons privacy and the person must give authorization to sell the image of their likeness. All photography with an identifiable human face must be accompanied with a model release. There will be no exceptions. Model releases can be found in the Document & Info section in My Account. If the person photographed is a minor, than authorization must to be signed by the parents or guardian. If the photograph is of the photographer (self-portrait), a model release is still required. If the photograph represents several recognizable people then a model release is required for each person before the image can be submitted. Property releases apply to buildings or real estate. Such releases are necessary for using photos of a private home or even a public business, but the restrictions are not as strict as they are with people. You need to be sure that a property is not misrepresented, or is presented in such a way that it promotes another product or service. Fair Use applies here because structures tend to be visible from public land. So, again, use has to be taken into context. |
